Exibeat – Terms & Conditions

1. Purpose of this Page

This website and platform are operated by Exibeat to:
- Introduce our vision and collect contact details from users wishing to receive early access updates
- Provide DJs and Producers with tools for track exchange, discovery, and collaboration

Users can create accounts, upload music tracks, submit them to DJ track requests, and DJs can download tracks for performance use. Users may also purchase or sell tracks via Exibeat’s payment system.

2. Eligibility

By using Exibeat, you confirm that:

  • You are at least 18 years old or the legal age in your country
  • You are voluntarily providing your own contact information
  • You have the legal right to upload and share the music files you submit

3. Privacy Policy – Data We Collect

We collect and store:

  • Email address (required)
  • Optional context (such as your name or artist role)
  • Account registration data (DJ/Producer profile details)
  • Uploaded track files and related metadata like BPM
  • Payment details (such as billing address, transaction records, and payout information) securely processed by third-party payment providers. We do not store or process any credit card information on our servers
  • Technical information (such as IP address, device/browser type, and usage logs) collected by us or trusted third parties for security, fraud prevention, and to ensure proper functionality of the service.

All payments are handled via GDPR-compliant payment processors (Stripe).

4. Purpose and Legal Basis

We process your data to:

  • Share updates about Exibeat’s development and early access opportunities
  • Understand general interest (aggregated)
  • Operate the platform’s services including track uploads, downloads, and user interactions
  • Enable financial transactions including track purchases

The legal basis is your explicit consent and service contract fulfilment in accordance with Article 6(1)(a)(b) GDPR.

5. Creating an account

When registering as a DJ or Producer:

  • You must provide accurate and up-to-date information.
  • You are responsible for maintaining the confidentiality of your login credentials. Please contact Exibeat immediately if you suspect unauthorized use of your account via our Customer Support
  • You agree not to use Exibeat for unlawful, infringing, abusive, or harmful purposes, including harassment, fraud, or distribution of malicious content.
  • For payment-related features, you may be required to provide accurate banking or payout details. Failure to do so may result in delayed or failed payments.
  • Exibeat reserves the right to suspend or terminate accounts at its sole discretion if these obligations are breached.

6. Uploading tracks (Producer users)

  • You keep full ownership of your tracks.
  • By uploading, you grant Exibeat a non-exclusive, royalty-free license to store, stream, and make your tracks available for DJs on the platform, valid while the track is available on Exibeat.
  • DJs you submit to may stream, download, and use tracks for personal listening, evaluation, and DJ performance. Redistribution or resale outside Exibeat is not allowed.
  • You confirm that uploads do not infringe third-party rights. You agree to indemnify and hold Exibeat harmless from any claims, damages, or expenses arising from content you upload that infringes third-party rights.
  • If you choose to sell tracks, you authorize Exibeat to process payments on your behalf and remit payouts according to our revenue-sharing model (currently 80% Producer / 20% Exibeat, unless otherwise stated).

7. Downloading tracks (DJ users)

  • You may download tracks submitted to you for evaluation, performance, and personal use.
  • Downloads may be free or paid, depending on the Producer’s choice.
  • Downloads are for personal DJ use only (including public performance). Redistribution, resale, or making tracks available to others is prohibited.
  • If you purchased or downloaded a track, it remains in your personal library even if the Producer later removes it from Exibeat.

8. Intellectual property

  • Exibeat does not claim ownership of your uploaded tracks
  • You grant Exibeat the necessary rights to store, display, and facilitate downloads of your content within the platform
  • Users must not upload copyrighted works they do not own or have rights to distribute
  • For paid content, you warrant that you own the rights to sell such works or have obtained all necessary licenses from rights holders.

9. Communication

By registering an account, you agree that Exibeat may send you:

Service communications (mandatory): account notices, payment confirmations, security alerts, and other essential information needed to use the platform. You cannot opt out of these.

Optional updates (marketing): product news, early access invites, feature updates, or promotional content. You may opt out of these at any time by clicking “unsubscribe” in the email or contacting us via our Customer Support

10. Third-Party Services

We may use secure third-party providers for hosting, email delivery, and platform functionality. These providers operate under GDPR-compliant agreements and do not use your data for their own purposes.

11. Cookies Policy - Cookies and Tracking

Exibeat uses cookies and similar technologies to operate, secure, and improve the platform.

  • Essential cookies (always active): required for secure and proper functioning (e.g. login sessions, payments, fraud prevention).
  • Analytics & performance cookies (consent required): help us understand usage and improve features.
  • Marketing & tracking cookies (consent required): may be set by us or trusted third parties to measure campaigns and provide relevant content.

On your first visit, you will see a cookie banner powered by Silktide Consent Manager, where you can accept, reject, or manage preferences. Some cookies are set by third-party providers (such as analytics or payment services).

Session cookies expire when you close your browser. Persistent cookies remain for a limited time unless deleted. You may change your cookie settings at any time via the dedicated cookie button display on the corner-left.

12. Privacy Policy - Your Data Rights

As a user, you have the following rights under GDPR:

  • Access & Copy – request a copy of the personal data you provided.
  • Correction & Deletion – request correction of inaccurate data or deletion where legally possible.
  • Restriction & Portability – request that processing is limited, or receive your data in a portable format.
  • Withdraw Consent – withdraw your consent at any time, without affecting prior lawful use.

13. Privacy Policy - Data Security and Retention

We host data in the EU and apply industry-standard encryption and access controls to protect your personal data against loss, misuse, and unauthorized access, in line with GDPR requirements.

Your data is retained: until you request deletion, or as long as necessary to provide the service and support. Payment and transaction records may be retained for up to 10 years in compliance with tax and accounting laws.

14. Payments and Fees

All payments on Exibeat are processed through third-party providers (Stripe, PayPal) under their terms of service. Producers receive payouts for track sales, minus Exibeat’s platform commission.

Payouts may be delayed if fraudulent activity is suspected. If you choose to close your account, please contact Exibeat via email. We will verify any remaining balance in your wallet and process a refund accordingly.

Refunds: Track purchases are non-refundable. By completing a purchase, you expressly consent to the immediate supply of digital content and acknowledge that this waives your statutory right of withdrawal under applicable consumer protection laws. Exceptions may apply only if the purchased file cannot be accessed or used due to technical issues (e.g., corrupted file, failed download, or system error). In such cases, we will first attempt to provide the correct file; if this is not possible, a refund may be issued.

Wallet refunds: If you choose to close your account, any remaining balance in your Exibeat wallet will be refunded after verification within 14 days. To initiate account closure, please contact Exibeat via email.

Chargebacks or disputes will be investigated; repeated fraudulent disputes may result in account suspension.

15. Governing Law

These Terms are governed by the laws of Germany. If you are a business user, jurisdiction is Leipzig, Saxony. If you are a consumer, mandatory legal provisions on jurisdiction apply.
